Distance Sales Agreement

Article 1 – Parties

BUYER: The person who registers on the website and/or places an order.

Article 2 – Subject of the Agreement

The subject of this agreement is to determine the rights and obligations of the parties regarding the sale and delivery of digital services and/or software products ordered electronically by the BUYER from the SELLER's website benai.ai, in accordance with the provisions of Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

Article 3 – Service Information

The type, duration, scope, and price of the purchased service are specified at the time of order. Digital services offered by Benai include:

  • SaaS software subscriptions (monthly/annual)
  • Custom software development services
  • AI consulting and integration services
  • Digital automation solutions

Article 4 – Payment Method

Payments can be made via credit card/debit card or wire transfer/EFT through benai.ai. For credit card payments, PayTR payment infrastructure is used. Payment information is processed securely, and card details are not stored on Benai servers.

Article 5 – Delivery

Digital services are delivered electronically upon payment confirmation. SaaS subscriptions are activated instantly. Custom software projects are delivered in phases according to the timeline specified in the project plan. Delivery notifications are sent to the BUYER's registered email address.

Article 6 – Right of Withdrawal

Pursuant to Article 15/ğ of the Distance Contracts Regulation, there is no right of withdrawal for services that are immediately performed electronically and digital content. The BUYER accepts this during the order process. However, for services that have not yet commenced, the BUYER may exercise the right of withdrawal within 14 days.

Article 7 – Refund Conditions

  • In case of exercising the right of withdrawal, the payment amount is refunded to the BUYER within 14 business days.
  • The refund is processed through the same payment method used for the original transaction (credit card, bank transfer, etc.).
  • Proportional charges apply for partially or fully performed services.

Article 8 – Seller's Obligations

  • To deliver the ordered service completely and in accordance with the contract terms.
  • To protect the BUYER's personal data under Personal Data Protection Law No. 6698 (KVKK).
  • To maintain service quality at the specified standards.

Article 9 – Buyer's Obligations

  • To provide accurate and up-to-date information during the order process.
  • To pay the service fee on time.
  • To use the service only for the purposes specified in the agreement.

Article 10 – Dispute Resolution

In disputes arising from this agreement, Consumer Arbitration Committees are authorized up to the value announced by the Ministry of Trade, and Consumer Courts are authorized for amounts above this value. The BUYER may apply to Consumer Arbitration Committees and Consumer Courts at their location or at the SELLER's headquarters (Istanbul).

Article 11 – Effectivity

This agreement enters into force on the date it is electronically approved by the BUYER. A copy of the agreement is sent to the BUYER's email address.

This Distance Sales Agreement has been prepared in accordance with the provisions of Consumer Protection Law No. 6502 and the Distance Contracts Regulation. The laws of the Republic of Turkey apply.
